Terms of Service for [Pooch Patrol de la Tierra]

Please read these Terms of Service carefully before using the services provided by [Pooch Patrol de la Tierra] ("we," "us," or "our"). By scheduling or using our pet waste removal services, you ("Client," "you," or "your") agree to be bound by these terms.

1. Service Agreement

a. Scope of Work: We agree to provide pet waste removal services at the Client's specified property according to the service schedule and frequency agreed upon. This includes locating, bagging, and disposing of pet waste from accessible areas of your yard. b. Exclusions: Our services do not include removal of waste from inside your home, kennels, or areas deemed inaccessible or unsafe by our technicians. We are not responsible for waste that is obscured by excessive leaves, snow, standing water, or overgrown vegetation. c. Service Days: Services will be performed on the agreed-upon day(s) of the week. While we strive for consistency, service times may vary. d. Access: You must provide clear and unobstructed access to your yard on your scheduled service day. If access is denied or obstructed (e.g., locked gates, aggressive pets, construction), we may be unable to perform the service, and a service fee may still apply.

2. Billing and Payment

a. Pricing: Service fees are based on the frequency of service, number of dogs, and yard size, as agreed upon at the time of booking. b. Payment: Payment is due [e.g., "in advance," "upon receipt of invoice," "on the first day of the service month"]. We accept [e.g., "credit card, debit card, bank transfer"]. c. Late Payments: A late fee of [e.g., "$15" or "1.5% per month"] may be applied to overdue invoices. d. Cancellations/Skipped Services: If you need to skip a service, please notify us at least [e.g., "24 hours"] in advance. Regular charges may apply for cancellations made with less notice. No refunds will be issued for services skipped without proper notification or due to inaccessible yards. e. Holiday Schedule: We observe major holidays. Services falling on a holiday will be rescheduled to the next business day or the closest alternative day. You will be notified of any holiday schedule changes.

3. Client Responsibilities

a. Pet Safety: All pets must be secured indoors or in an area inaccessible to our technicians during service visits. We are not responsible for pets that escape due to unlocked gates or open doors left by the Client or others. b. Yard Maintenance: Please ensure your yard is reasonably maintained (e.g., grass mowed, debris cleared) to allow our technicians to perform their duties efficiently. c. Water Access: For some services, access to an outdoor water spigot may be required.

4. Photo Clause

Client grants [Pooch Patrol de la Tierra] permission to take photographs of the work performed and the general project area within their yard during and after the completion of services. These images are primarily for documentation of completed work, quality assurance, and may be used in our company's portfolio, website, and marketing materials (e.g., social media posts, advertisements showcasing our services).

We will make reasonable efforts to ensure that such images focus on the cleaned areas and the results of our service, and do not intentionally capture identifiable personal information of the Client or their household (e.g., faces, personal belongings, clear house numbers).

If you prefer that we do not take photos of your property for marketing purposes, you must notify [Pooch Patrol de la Tierra] in writing prior to the commencement of services. Even if you opt out of marketing photos, we reserve the right to take photos for internal quality control and documentation purposes.

5. Liability and Disclaimer

a. Property Damage: We will exercise reasonable care while on your property. However, we are not liable for damage to property that is not directly caused by our negligence during service. Please ensure gates are secure and property is free of fragile items in service areas. b. Pet Health: We are not responsible for the health or well-being of your pets. If you suspect your pet has ingested waste or foreign objects, please contact your veterinarian immediately. c. Satisfaction Guarantee: If you are not satisfied with a service, please contact us within [e.g., "24 hours"] of the service, and we will re-service your yard at no additional charge.

6. Termination of Service

Either party may terminate services with [e.g., "7 days'"] written notice. We reserve the right to terminate services immediately if these terms are violated or if our staff feels unsafe on the property.

7. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the State of New Mexico.

8. Amendments

We reserve the right to update or modify these Terms of Service at any time. Any changes will be effective immediately upon posting on our website or providing notice to you. Your continued use of our services after any such changes constitutes your acceptance of the new Terms of Service.
